Legal Update: Recent Regulations of the Ministry of Commerce as of May 2020
- The Revision of Public Service Fees of the Ministry of Commerce
Under Prakas No.333 dated 27 March 2020, three public service fee of the Ministry of Commerce will be revised as below:

- Announcement on Maintaining Goods Price on Market within Cambodia
Amid the outbreak of Covid-19 virus, certain shop owners, business owners and certain online sellers has unreasonably raise their goods price, particularly the price of face masks, hand sanitizer, thermometer and other necessary food products. The high rise of these goods’ price is seen to have a great economic impact by the Ministry of Commerce. For such reason, on 27 March 2020, the Ministry of Commerce has called for the stabilization of product price in the market. According to the notification, any seller who excessively raises the goods price may face fine under law.
- Notification on Temporarily Suspension Paddy Rice and White Rice Exports
On 30 March 2020, the Ministry of Commerce issued a notification to temporary suspend the export of paddy rice and white rice. The suspension will take effect from 05 April 2020 until further notice.
The measure is to ensure food security as well as rice price stability within Cambodia. Cambodia Rice Federation, rice mill owner and business owner may contact to Green Trade Company of Ministry of Commerce and Rural Development Banks for information on credit facility and food security during outbreak of COVID-19 virus.
- Notification on Warning all Fuel Stations and Depot Owners for Unreasonable High Price dated 02 April 2020
On 02 April 2020, the Ministry of Commerce has warned that any enterprise owners and fuel stations or depot owners selling fuel shall set their fuel price according to the Ministry’s threshold and shall not cheat on the quantity and fuel quality. The warning is issued after certain enterprise owners and fuel stations or depot owners have continued to violate the law. From the date of this Notification, the Ministry of Commerce may impose transitional fines, suspend business operations or submit a complaint to the court.
- Notification on Online System for the Certificate of Origin Form D
On 7 May 2020, the Ministry of Commerce announce that it will updates the online system for Certificate of Origin Form D (“CO Form D”) from 01 June 2020 onward. The adjustment is for purpose of complying with ASEAN Single Window which will include:
- The removing of information on means of transport (such as “by Sea”, “by Truck”, “by Air”) from Box N. 3 (Means of Transport);
- The system will automatically indicate HS Code of registered goods in the first row of each goods description in Box 7;
- The system will automatically indicate the Amount of Package in the last row of each goods description in Box 7;
- The system will automatically indicate the Item Number of each goods description in Box 5;
- The system will allow exporter to register goods up to 10 digits or 11 digits of HS Code;
- The requiring on exporter to input FOB Value of each goods in accordance with attaching invoice; and
The requiring on exporter to double check whether the approved CO Form D is received by the system of destination country.
