{"id":3405,"date":"2026-04-30T09:26:35","date_gmt":"2026-04-30T09:26:35","guid":{"rendered":"https:\/\/sithisak-lawoffice.com\/?post_type=resource-legals-news&#038;p=3405"},"modified":"2026-04-30T09:26:35","modified_gmt":"2026-04-30T09:26:35","slug":"s3-e1-compliance-co-owned-building-development-business","status":"publish","type":"resource-legals-news","link":"https:\/\/sithisak-lawoffice.com\/ja\/resource-legals-news\/s3-e1-compliance-co-owned-building-development-business\/","title":{"rendered":"S3 E1: Compliance: Co-owned Building Development Business"},"content":{"rendered":"\n<p>Compliance: Co-owned Building Development Business<\/p>\n\n\n\n<figure class=\"wp-block-embed is-provider-youtube wp-block-embed-youtube\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"S3 E1: Compliance: Co-owned Building Development Business\" width=\"750\" height=\"422\" src=\"https:\/\/www.youtube.com\/embed\/e1n9d6Y6emQ?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>According to Sub-Decree No. 050 dated 2 February 2023 on the Management of Real Estate Development Business, all co-owned building development business shall prior obtain license or permit from the Real Estate Business and Pawnshop Regulator (the \u201cRPR\u201d) or the Municipal\/Provincial Department of Economics and Finance (DEF).<\/p>\n\n\n\n<p>License or permit for the co-owned building development business has been classified into two types as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Type 1: granted to any developer who has completed construction, before sales and lease announcements; and<\/li>\n\n\n\n<li>Type 2: granted to any developer who starts construction while also announcing progressive sales or leases.<\/li>\n<\/ul>\n\n\n\n<p>Any person who is intended to conduct co-owned building development business shall:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Maintain a minimum capital of 20% of construction cost for license Type 2;<\/li>\n\n\n\n<li>Maintain a capital 100% of construction cost for license Type 1;<\/li>\n\n\n\n<li>Provide business guarantee deposit;<\/li>\n\n\n\n<li>Open a real estate development account at a commercial bank in Cambodia;<\/li>\n\n\n\n<li>Prepare a project development business plan; and<\/li>\n\n\n\n<li>Other conditions determined by the RPR.<\/li>\n<\/ol>\n\n\n\n<p>Any person who is conducted co-owned building development business without any license from the RPR shall be fined from 150,000,000 Riels to 500,000,000 Riels and shall suspended such business immediately.
