{"id":583,"date":"2023-02-03T08:31:00","date_gmt":"2023-02-03T08:31:00","guid":{"rendered":"https:\/\/sithisak-lawoffice.com\/?post_type=resource-legals-news&#038;p=583"},"modified":"2025-12-29T02:52:57","modified_gmt":"2025-12-29T02:52:57","slug":"legal-update-accreditation-of-valuation-company-in-the-trust-sector","status":"publish","type":"resource-legals-news","link":"https:\/\/sithisak-lawoffice.com\/km-kh\/resource-legals-news\/legal-update-accreditation-of-valuation-company-in-the-trust-sector\/","title":{"rendered":"Legal Update: Accreditation of Valuation Company in the Trust Sector"},"content":{"rendered":"\n<p><em>Issue: No. 002P\/23 \u2013 3 February 2023<\/em><\/p>\n\n\n\n<p>On 3 November 2022, the Non-Bank Financial Services Authority (\u201c<strong>NBFSA<\/strong>\u201d) issued a Prakas No. 052 Or.S.H\/ Pr.K on the Accreditation of Valuation Company in the Trust Sector, which composes of 6 chapters and 27 articles (the \u201c<strong>Prakas<\/strong>\u201d).<\/p>\n\n\n\n<p>This Prakas aims to determine the conditions and procedures to accredit real estate valuation company and real estate appraiser in the trust sector from the Trust Regulator (the \u201c<strong>TR<\/strong>\u201d), as well as rights and obligations for doing businesses in accordance with the laws and regulations in the trust sector.<\/p>\n\n\n\n<p>The significate aspects of this Prakas are illustrated as follows:<\/p>\n\n\n\n<p><strong>Conditions to be a valuation company and an appraiser<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table big-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Type<\/strong><\/td><td><strong>Conditions&nbsp;<\/strong><strong>for Applying for Accreditation\/Qualified Accreditation<\/strong><\/td><td><strong>Renewal of Accreditation<\/strong><\/td><\/tr><tr><td><strong>Valuation Company<\/strong><\/td><td>\u2013&nbsp;&nbsp; \u200bObtained a license from the REBPR;\u2013&nbsp;&nbsp; Established and doing business in Cambodia at least 2 years from the application date;\u2013&nbsp;&nbsp; Having at least 1 appraiser.<\/td><td>15 days before the expiration date of accreditation<\/td><\/tr><tr><td><strong>Appraisers<\/strong><\/td><td>\u2013&nbsp;&nbsp; Having a certificate from the REBPR;\u2013&nbsp;&nbsp; Having appraisal experience in the real estate sector at least 3 years;\u2013&nbsp;&nbsp; Obtained an appointment letter from the valuation company;\u2013&nbsp;&nbsp; Attended a training course and examination arranged by TR or other training institutions authorized by TR with a validity of 2 years.<\/td><td>15 days before the expiration date of qualified accreditation<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><strong>The obligations of accredit<\/strong><strong>ed<\/strong><strong>&nbsp;valuation company and appraiser<\/strong><\/p>\n\n\n\n<p>The valuation company and appraiser shall fulfill the following obligations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Comply with the required standards;<\/li>\n\n\n\n<li>Prepare an appraisal report with the minimum information;<\/li>\n\n\n\n<li>Report to TL in some cases; and<\/li>\n\n\n\n<li>Provide annual operation report to TL within 3 months after each financial year ended.<\/li>\n<\/ul>\n\n\n\n<p><strong>Annual Fee<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Type<\/strong><\/td><td><strong>Application Fee (Riels) Per Year<\/strong><\/td><td><strong>Application Examination Fee (Riels) Per Year<\/strong><\/td><td><strong>Accreditation Fee (Riels) Per Year<\/strong><\/td><td><strong>Total (Riels) Per Year<\/strong><\/td><\/tr><tr><td><strong>Valuation Company<\/strong><\/td><td>20,000<\/td><td>200,000<\/td><td>500,000<\/td><td>720,000<\/td><\/tr><tr><td><strong>Appraiser<\/strong><\/td><td>20,000<\/td><td>100,000<\/td><td>200,000<\/td><td>320,000<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Please note that the application fee and application examination fee will not be refunded, in despite of the application form has been rejected by TR.<\/p>\n\n\n\n<p><strong>Penalties:<\/strong><\/p>\n\n\n\n<p>The valuation company and appraiser who violates any accreditation conditions shall be subject to an administrative sanction as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Warning;<\/li>\n\n\n\n<li>Rectification instruction;<\/li>\n\n\n\n<li>Restriction on accreditation;<\/li>\n\n\n\n<li>Suspension of accreditation; and<\/li>\n\n\n\n<li>Revocation of accreditation.<\/li>\n<\/ul>\n\n\n\n<p><strong>Disclaimer<\/strong><\/p>\n\n\n\n<p>The article is merely for general information purposes.
