Legal Update: Amendment to (7) and (8) of Article 3 in the Prakas No.013 DNS/Br.K/Ni.K on Formalities and Procedure for Issuance of Construction Permit

On 20 January 2022, the Ministry of Land Management, Urban Planning and Construction (the “Ministry”) has been issued a Prakas No. 013 DNS/Br.K/Ni.K on Formalities and Procedure for the Issuance of Construction Permit (the “Prakas No. 013”), which aims to determine the formalities and procedures for issuing and renewing construction permits.
After that, on 22 June 2022, the Ministry has issued a Prakas No. 096 DNS/Br.K/Ni.K (the “Prakas No 096”) to amend (7) and (8) of Article 3 of the Prakas No. 013, which amend the definition of “Cadastre Confirmation Letter” and “Land Measurement.” This Prakas is composed of 03 Articles.
The table below illustrates the difference between (7) and (8) of Article 3 in the Prakas No. 013 and (7 new) and (8 new) of Article 1 in Prakas No. 096.

(8) old | Land Measurement refers to documents provided by the Municipal and Provincial Department of Land Management, Urban Planning, Construction and Cadastre, which specify the plan of the plot land, area plan, proprietor of land, land location, land size, land coordinates, land type, use of the land area, construction status in and around the land, and photo of plot land condition. | (8) new | Land Measurement refers to documents provided by the General Department of Cadastre and Geography, which specify the plan of the land plot, area plan, proprietor of the land, land location, land size, and land coordinates.
