I believe that many of us are already familiar with and know about ‘interest’ in our daily lives. But from a legal perspective, what form does it take, and what exactly is called interest? interest arises from the creation of a claim right between the relationship of the parties. The parties here referring to the creditor and the debtor. Therefore, “interest” is the consideration that the borrower or debtor must pay to the lender (or creditor) based on the principal amount and the duration of the loan.

Normally, interest rates can be set by law or by mutual agreement of the parties. If the parties do not specify an interest rate, the statutory interest rate determined by law is 5% per year. Separately, the parties may set an interest rate by agreement that does not exceed 18% per year. Furthermore, this determination must strictly be made in writing and signed by the borrower or debtor.
Part 3: Legal Measures in Case of Excessive Interest Rates
In key point here, that parties can set interest rates higher than 5%, but cannot exceed the maximum limit specified by law. What if a rate exceeding the limit is specified? In that case, the excess portion shall be null and void (having no legal effect). Moreover, if the borrower has already paid that excess interest, the law protects the borrower by offsetting the excess amount against the principal debt. If any excess remains after offsetting the principal, the lender or creditor must refund it to the debtor, along with compensation for damages.
